How about once a month the ipod/iphone would require to connect to the
Internet to check to make sure that a cod had not been revoked. most
of the time this would not be noticed as this could be a background
operation.

If no internet connection was available at the time when it needed to
confirm you could have a 5 day countdown until the software reverted
to unlicensed. There are very few people that will not be able to get
internet access within 5 days.
